The Indian government has told the Supreme Court that it wants Kerala nurse Nimisha Priya to return home safely from Yemen, where she faces the death penalty. The government also warned against private individuals or groups trying to step in on their own, saying such efforts could disturb ongoing sensitive diplomatic talks.

What’s the Case?
Nimisha Priya, a 38-year-old nurse from Kerala, was sentenced to death in Yemen for the 2017 murder of a Yemeni man named Talal Abdo Mahdi, who was also her former business partner. Reports say that she gave him a sedative to take back her passport, which he had taken away. Unfortunately, he died from the overdose. She was convicted in 2020, and her death sentence was upheld in 2023.

Hope for a Reprieve
Yemen follows Sharia law, which allows a murder convict to avoid execution if the victim’s family agrees to accept ‘diyat’, or blood money, and forgives the convict. Priya’s family and supporters were hoping for this kind of agreement. However, the victim’s family has refused all offers, saying the case is about their "honour" and insisting on the execution.

Supreme Court Hearing
On Friday, the Attorney General R Venkataramani told the Supreme Court that any uncoordinated actions by individuals or groups could damage diplomatic talks. He added that India has already used all possible official and backdoor ways to try and help her, including involving respected religious leaders.

The Supreme Court refused to allow members of the Save Nimisha Priya International Action Council to travel to Yemen, suggesting they should go through the proper government channels instead. The next hearing is set for August 14.

Family’s Pain and Efforts
Priya’s mother, Prema Kumari, has been staying in Yemen for over a year, trying to convince the victim’s family to forgive her daughter. She has claimed that Priya faced mental, physical, and financial abuse and that the act was out of desperation, not planned.

India’s Limitations
India does not have formal diplomatic ties with Yemen, especially as parts of the country are under the control of Houthi rebels. Despite this, the Indian government has tried its best, even involving religious figures to stop the execution, which was scheduled for July 16 but has now been paused.

In the end, both the government and the court agreed on one thing: everyone wants Nimisha Priya to return safely — but it must be done carefully.

"आम्हाला तिचं फक्त सुखरूप परतणं हवंय" – निमिषा प्रिया प्रकरणात सरकारची सावधपणे वाटचाल

भारत सरकारने सर्वोच्च न्यायालयाला सांगितले आहे की, ती केरळची नर्स निमिषा प्रिया ही सुखरूप भारतात परतावी, अशीच आपली इच्छा आहे. सध्या ती येमनमध्ये फाशीची शिक्षा भोगत आहे. याचवेळी सरकारने खासगी संस्था आणि व्यक्तींना स्वतःहून हस्तक्षेप करू नका, असा इशारा दिला आहे कारण यामुळे चालू असलेले संवेदनशील राजनैतिक प्रयत्न बिघडू शकतात.

प्रकरण काय आहे?

निमिषा प्रिया (38) ही केरळमधील परिचारिका 2017 मध्ये येमनी नागरिक तलाल अब्दो महदी यांच्या खुनाच्या आरोपाखाली दोषी ठरली होती. तलाल हा तिचा माजी व्यावसायिक भागीदार होता. रिपोर्टनुसार, तलालने तिचा पासपोर्ट घेतल्यामुळे तिने त्याला निश्चेतक औषधाचे इंजेक्शन दिले, पण जास्त डोसमुळे त्याचा मृत्यू झाला. 2020 मध्ये तिच्यावर खुनाचा दोष सिद्ध झाला आणि 2023 मध्ये तिच्या फाशीच्या शिक्षेला न्यायालयाने मंजुरी दिली.

आशेचा किरण – दयायाचना

येमनमध्ये शरिया कायदा लागू आहे. त्यानुसार, खुनाच्या गुन्ह्यात दोषी असलेल्या व्यक्तीला दियत म्हणजेच रक्तपैशाच्या मोबदल्यात माफ केले जाऊ शकते, जर मृताच्या कुटुंबाने माफ केले तर. निमिषाच्या कुटुंबीयांनी आणि समर्थकांनी हीच वाट शोधण्याचा प्रयत्न केला, पण मृत व्यक्तीच्या कुटुंबाने ही संधी नाकारली. त्यांच्या मते हा सन्मानाचा मुद्दा आहे आणि फाशीच पाहिजे.

सर्वोच्च न्यायालयातील सुनावणी

शुक्रवारी, अटर्नी जनरल आर. वेंकटरमणी यांनी न्यायालयात सांगितले की, कोणतेही स्वतंत्रपणे केलेले प्रयत्न धोका निर्माण करू शकतात. सरकारने याआधी सर्व शासकीय आणि खासगी मार्ग वापरून प्रयत्न केले, त्यात प्रसिद्ध इस्लामी धर्मगुरूंचाही समावेश होता.

Save Nimisha Priya International Action Council या संस्थेने आपल्या सदस्यांना येमनला पाठवण्याची परवानगी मागितली होती, पण न्यायालयाने ती नाकारली. याऐवजी संस्थेला सरकारकडे अधिकृत निवेदन देण्यास सांगितले, आणि सरकारने ते "स्वतःच्या merit वर विचारात घेणार" असे न्यायालयाने स्पष्ट केले. पुढील सुनावणी 14 ऑगस्ट रोजी होणार आहे.

कुटुंबीयांचा संघर्ष

निमिषाची आई प्रेमा कुमारी, ही मागील एक वर्षाहून अधिक काळापासून येमनमध्ये राहत आहे. ती सतत मृताच्या कुटुंबाशी संपर्क साधण्याचा प्रयत्न करत आहे. तिचा दावा आहे की, निमिषावर मानसिक, शारीरिक आणि आर्थिक अत्याचार झाले आणि तिच्याकडून झालेली कृती ही आत्मरक्षणातून व हतबलतेतून घडलेली होती, पूर्वनियोजित नव्हती.

भारत सरकारची मर्यादा

भारताचे येमनशी औपचारिक राजनैतिक संबंध नाहीत, शिवाय येमनमधील अनेक भाग, राजधानी सानासह, हौथी बंडखोरांच्या नियंत्रणाखाली आहेत. यामुळे परिस्थिती आणखी गुंतागुंतीची झाली आहे. तरीही सरकारने फाशी थांबवण्यासाठी अनेक स्तरांवर प्रयत्न केले, आणि 16 जुलै रोजीची फाशी तूर्तास थांबवण्यात आली आहे.
